HOUSE CONCURRENT RESOLUTION NO. 8

(By Delegates Kuhn, Tucker, Hatfield, Perdue,

Prunty, Angotti and Overington)
[Introduced February 28, 2001; referred to the
Committee on Rules.]
Requesting the Joint Committee on Government and Finance to conduct
a study to review the effect of transferring the statutory
provisions governing the real estate commission to chapter
thirty of the code of West Virginia with other state
professional and occupational licensing boards.

Whereas, The Legislature is charged with protecting the public
interest in the practice of many occupations and professions; and

Whereas, The State regulates and monitors the practice of
professions through licensing boards, which are in turn responsible
for ensuring the certification of those professionals practicing in
the profession being regulated; and

Whereas, There is concern within the real estate community that
transferring the provisions governing the commission might result
in difficulty for full compliance with all laws and rules governing
a professional board; and

Whereas, It is the desire of the Legislature to afford all interested parties the opportunity to offer their ideas, advice and
suggestions, so that such a transition, if considered advisable by
the Legislature, will cause the least amount of concern and
confusion to the public and to the commission; therefore, be it

Resolved by the Legislature of West Virginia:

That the Joint Committee on Government and Finance is hereby
requested to study the possibility of transferring the provisions
governing the real estate commission from chapter forty-seven to
chapter thirty of the code of West Virginia, with specific emphasis
on the discrepancies including membership, meetings, notification
of rules, fee collection, licenses, continuing education,
jurisdiction of appeals, and rosters that might occur with any
transfer; and, be it

Further Resolved, That the Joint Committee on Government and
Finance report to the regular session of the Legislature, 2002, on
its findings, conclusions and recommendations, together with drafts
of any legislation necessary to effectuate its recommendations;
and, be it

Further Resolved, That the expenses necessary to conduct this
study, to prepare a report and to draft necessary legislation be
paid from legislative appropriations to the Joint Committee on Government and Finance.

NOTE: This resolution was recommended for passage during the
2001 regular session by the Joint Standing Committee on Government
Organization.
